1. ELIGIBILITY: Tic Tac ^® "Refresh Your Summer 2025" Sweepstakes(the "Sweepstakes" or “Promotion”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are twenty one (21) years of age or older and have a valid email account as of the date of entry ("Eligible Entrants"). Employees of Ferrero U.S.A., Inc. ("Sponsor"), its parent, affiliates, subsidiaries, its promotion, advertising and internet agencies, including Administrator as defined below, Festival Entities, and prize suppliers, (and their respective employees, directors, officers and agents) (collectively, the "Released Parties"), and each member of their immediate family (spouse, parent, children and siblings and their respective spouses, regardless of where they reside) and/or those persons living in the same household, whether or not related, are not eligible to enter or win. Void in Puerto Rico, where prohibited or where restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Administrator’s server shall be the official timekeeper for the Sweepstakes.

2. HOW TO ENTER:The Sweepstakes shall begin at 12:00:00 a.m. Eastern Time ("ET") on May 1, 2025 and end at 11:59:59 p.m. ET on June 29, 2025 ("Promotion Period"). During the Promotion Period, Entrants will be directed to www.tictacsummer.com and instructed to follow the on-screen directions to complete and submit the online entry form, which includes entering Entrant's first and last name and e-mail address. Submission of the completed online entry form will result in:

• One (1) entry in the Grand Prize random drawing for a chance to win a Grand Prize;
• One (1) instant win game play for a chance to win an instant win prize. (After transmission of completed online entry form, Entrant will receive either a “Winning” or “Non-winning” message. If “Winning” message is received, Entrant is a potential winner of an instant win prize, subject to verification. If “Non-winning” message is received, Entrant is not a potential winner of an instant win prize.)

There is no purchase necessary to enter the Promotion and play the instant win game. There are two (2) ways to enter/play, as described below:

a. Enter/Play with a purchase: You may enter the Promotion (including instant win game play) by purchasing an eligible Tic Tac product in one (1) or multiple transactions at any participating retailer during the Promotion Period (“Eligible Purchase”). To enter the Promotion (and play the instant win game) you must visit www.tictacsummer.com and enter the Eligible Purchase UPC (Universal Product Code) located on the Tic Tac product package as well as completing all required information on the online entry form (including name, email address and complete mailing address [which will be used only for award of prize if determined to be a winner]). To result in entry/game play, Eligible Purchase UPC must be inputted exactly as it appears on eligible Tic Tac product package. All Eligible Entries via this method must be received by 11:59:59 p.m. ET on 6/29/2025.

b. Enter/Play without a purchase: You may enter the Promotion (including instant win game play) without making a purchase by visiting www.tictacsummer.com/amoe and following the on-screen instructions to register for the Sweepstakes (and play the instant win game) by submitting all requested information (including name, email address and complete mailing address [which will be used only for award of prize if determined to be a winner]). The URL may be subject to change throughout the course of the Promotion Period. All Eligible Entries via this method must be received by 11:59:59 p.m. ET on 6/29/2025.

By entering using a mobile device, entry may require data usage or incur data usage charges. Such charges may apply regardless of whether you are successful in entering the Promotion (including instant win game play). Check your mobile plan for rates/details before submitting an entry. Wireless access may not be available in all areas.

Limit one (1) entry/play per Eligible UPC per person/email address per day. Limit four (4) entries/plays without purchase per person/email address per Promotion Period. Additional Sweepstakes entries received from the same person or e-mail address after the entry limit will be void; egregious or repeated violations may result in disqualification from Sweepstakes. Receipt of entries will be acknowledged and, any such acknowledgment does not constitute any representation as to eligibility for the Sweepstakes nor is it otherwise binding upon Sponsor/Administrator . Sponsor and Administrator are not responsible for late, lost, garbled/undecipherable, inaccessible, blocked, corrupted, misdirected, incomplete, incorrect, or invalid entries, which will be disqualified.

Any attempt by any entrant to enter or play the instant win game by using multiple/different email addresses, mailing addresses, identities, registrations, or any other methods will void such entries/game plays (and forfeiture of instant win prize if game play is a winner) and that entrant may be disqualified. Use of any automated or computer system to participate online is prohibited and will result in disqualification with all entries/game plays being declared void (with forfeiture of instant win prize if game play is a winner). Normal Internet/phone access and data/usage charges imposed by your online/phone service may apply.

Sponsor reserves the right in its sole discretion to disqualify any Entry that, in its sole opinion, refers, depicts, or in any way reflects negatively upon the Sponsor, Sponsor’s products, or any other person or entity, or does not comply with these requirements or these Official Rules .

3. WINNER SELECTION FOR GRAND PRIZE AND INSTANT WIN PRIZES. There will be a total of two (2) Grand Prizes, and one hundred and ninety-two (192) instant win prizes (made available to be won instantly). The Grand Prize random drawing will be conducted by the Administrator, whose decisions are final on all matters relating thereto. Odds of winning a Grand Prize depends upon the number of Eligible Entries received during Promotion Period.

A total of one hundred and ninety-two (192) instant win prizes will be randomly allocated by Administrator to randomly pre-selected dates/times during the Promotion Period. The first person to transmit a completed online entry form on or after a randomly pre-selected time will win the type of instant win prize randomly allocated to that time.

AN ENTRANT IS NOT A WINNER OF AN INSTANT WIN PRIZE UNLESS AND UNTIL THEY HAVE SEEN THE CONFIRMATION MESSAGE ON SCREEN. BUT, SCREEN SHOTS WILL NOT BE ACCEPTED AS PROOF OF WINNING.

Instant win prize winner must follow the on-screen instructions to claim the instant win prize. If not claimed at time of verification notice, such instant win prize will be forfeited and not awarded.

UNCLAIMED INSTANT WIN PRIZES MAY NOT BE AWARDED.

Odds of winning an instant win prize depend on the number of eligible entries received and the time/date that a given Entrant submits their eligible entry.

4. WINNER NOTIFICATION- GRAND PRIZE, INSTANT WIN PRIZES: Potential Instant Win prize winners will be notified instantly after submission of completed online entry form. Potential Grand Prize winners will be notified via e-mail on or about July 1, 2025. Potential Grand Prize winner and potential instant win prize A winners will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and (where lawful) a Publicity Release within 48 hours of notification. Failure to do so for any reason; if potential Grand Prize or instant win prize A winner cannot be contacted for any reason (including prize notification email being classified as “Junk” or “SPAM”; for instant win prize A, prize claim procedure is interrupted or corrupted in any way); or, if potential winner is determined by Administrator to be ineligible or not in full compliance with these Official Rules, will result in forfeiture of Grand Prize or instant win prize A. If Grand Prize is forfeited, an alternate potential Grand Prize winner may be selected from among all remaining eligible entries received for the Grand Prize random drawing (time permitting). If instant win prize A is forfeited, instant win prize may be reallocated to a later date/time in the Promotion Period (time permitting).

5. PRIZES:

Grand Prize: There will be two (2) Grand Prizes awarded (“Grand Prize”). Each Grand Prize winner will receive: (i) a 5-night stay at Hotel (TBD) in Chicago IL., for winner and one (1) guest who must be 21 years or older (1 premium room/double occupancy), (ii) Domestic economy roundtrip air travel for winner and one (1) guest from an airport near the winner’s home to an airport near Chicago, IL, (iii) Includes car transportation to and from Chicago airport, (iv) Includes a total of $1,000 spending cash, and (v) two (2) 4-day VIP Tickets to the 2025 Lollapalooza Music Festival in Chicago, IL on July 31, 2025 – August 3, 2025 ( “LOLLAPALOOZA”). VIP tickets include: unlimited access to Lolla Lounges featuring relaxed seating, shade and air-conditioned restrooms plus direct access to the on-field viewing areas to include dedicated food for purchase, Golf cart shuttle transportation between Lolla Lounges North and South, Jumbo screen in Lolla Lounge North with live streaming from the main stages, complimentary express festival hair and glitter treatments, lawn games and more, dedicated VIP Concierge to assist with your festival needs, and dedicated premium entrance into the festival. Grand Prize winner and guest must verify they are 21+ in order to receive the full benefits of the VIP experience. Any guest under the age of 21 will not be able to partake in the full service bar element of the Grand Prize package.

Instant Win Prize A: A total of twenty four (24) 4-day General Admission instant win prizes, each prize consisting of a pair (2 tickets) of a 4-Day General Admission to Grant Park for ALL four days of the festival. DOES NOT INCLUDE ACCOMODATIONS OR TRANSPORTATION TO AND FROM VENUE.

To accept Grand Prize, or instant win Prize “A”:

(a) Winner and guest must be available to attend the LOLLAPALOOZA; if winner cannot do so for any reason, prize will be forfeited without compensation of any kind. If Grand Prize or instant win Prize “A” is forfeited, an alternate winner may be selected (time permitting);

(b) Tickets to the LOLLAPALOOZA are subject to terms and conditions of use as indicated thereon/provided therewith. Tickets are not intended for use by anyone other than winner and his/her guest(s) including but not limited to provision to another via re-sale, exchange or barter. The LOLLAPALOOZA is an outdoor event and subject to postponement or cancellation due to inclement weather. Venue restrictions also apply, perhaps including security screening, prohibition on bringing weapons and other items into venue as well as restrictions on size and type of bags allowed in venue.

(c) Winner and guest must at all times act in an appropriate, well-behaved, and respectful manner as well as following all safety and other instructions as well as venue code of conduct during attendance at the LOLLAPALOOZA. The preceding includes but is not limited laws/regulations or policies (of the United States or any political subdivision thereof or any business entity) designed to prevent the spread of COVID-19/Coronavirus; such as, mask-wearing, social distancing, providing proof of negative COVID-19/Coronavirus test and/or providing proof of vaccination against COVID-19/Coronavirus. Violation of such any of the foregoing may result in termination of prize in which case Sponsor and Administrator shall not have any liability under any legal theory.

(d) Winner and guest must abide by all LOLLAPALOOZA and venue policies. Festival Entities reserve the right to revoke full or partial prize from any winner or winner’s guest who it or venue/LOLLAPALOOZA personnel deem may, in its sole discretion, be intoxicated, be a safety risk, have violated any venue/LOLLAPALOOA policy or law, or may bring LOLLAPALOOZA into disrepute. Winner and guest must have a valid state-issued driver’s license or Real ID-compliant license or ID for identification purposes and to claim tickets. Winner understands that there are inherent risks involved in attending a festival in a public place and that these risks may be present before, during and after LOLLAPALOOZA. Any unclaimed and/or unused tickets will remain the property of Festival Entities. Resale of tickets is prohibited. By claiming tickets, winner must agree to ticketing Terms of Use (https://www.frontgatetickets.com/terms-of-use) and to abide by the health and safety measures in effect at the time of LOLLAPALOOZA.

For Grand Prize:

(a) Winner and guest must travel together on same itinerary. Flights will be determined by Sponsor/Administrator in their sole discretion. Valid travel documents are required for travel and are the sole responsibility of winner and guest.

(b) Guest of winner must complete, sign, and return a Liability Release and a Publicity Release (where lawful) prior to travel. If guest fails to do so, the Grand Prize will be awarded in an increment appropriate for the winner to the 2025 LOLLAPALOOZA Festival and no substitute prize or compensation will be awarded.

(c) If winner chooses to accept the Grand Prize without a guest, the Grand Prize will be awarded in an increment appropriate for the winner and no substitute prize or compensation will be awarded.

(d) Should winner live within reasonable driving distance of Chicago, IL, Sponsor will replace air travel with ground transportation (or a stipend in an amount of its sole choosing to be used for same) and no substitute prize or compensation will be awarded.

(e) Winner and guest will not receive frequent flier miles, award points or other “perks” in conjunction with prize travel.

LIMIT ONE (1) GRAND PRIZE AND/OR ONE (1) INSTANT WIN PRIZE PER PERSON, PER HOUSEHOLD AND/OR PER EMAIL ADDRESS DURING THE PROMOTION PERIOD.

No cash substitute or alternate prize will be awarded except by Sponsor.

6. ADDITIONAL PRIZE RESTRICTIONS: Winners may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release, and a Publicity Release (where lawful) within an indicated time period as a condition of receipt of prize. Failure to do so or if winner is determined to be ineligible or otherwise not in compliance with these Official Rules will result in prize forfeiture. In such case, an alternate Grand Prize may be selected from among remaining eligible entries received for the Grand Prize drawing (time permitting) and instant win prize A may be reallocated to a later date/time in the Promotion Period (time permitting). Prizes to be awarded "as is" and any and all warranties and/or guarantees (if any) shall be subject to the manufacturers'/suppliers’ terms; therefore, Winners agree to look solely to such manufacturer(s)/supplier(s) for any such warranty(s) and/or guarantee(s), if any. Any prize depiction is for illustrative purposes only. Sponsor shall not be responsible for lost or stolen Prizes, or any part thereof, or any issues arising out of or in connection with Winner's use of a Prize, or any part thereof. Prizes consist of only the items specifically listed as part of the Prize. No prize transfer or cash redemption are permitted. No prize substitution, in whole or in part, except by Sponsor who reserves the right to substitute a prize (in whole or in part) of comparable or greater value, at its sole discretion. Except with Sponsor's written consent (which may be granted or withheld by Sponsor without liability of any kind), prize must be accepted as awarded. Any stated difference between the approximate retail value and actual value of prize (or any component thereof) or any substituted prize (or any component thereof) will not be awarded. Winner is solely responsible for any costs and expenses in connection with the prize not expressly described herein as being awarded including, without limitation, all federal, state, or local taxes (if any) on the prize and any additional costs and expenses associated with the acceptance and use of the prize that are not described herein as being awarded. For Grand Prize and instant win prize A, Sponsor will report winner’s receipt of Grand Prize/instant win prize A as well as any other prize won by such winner to the Internal Revenue Service via IRS 1099 Tax Form; and, winner agrees to provide his/her Social Security Number or Tax Identification Number to Sponsor or its representative upon request (as well as to otherwise fully cooperate Sponsor or its representative) so that Sponsor may comply with this requirement. In no event will more than the stated number of prizes be awarded. For Grand Prize, Sponsor reserves the right to ship various prize components separately.

7. LIMITATION OF LIABILITY: No liability or responsibility is assumed by Sponsor or the Released Parties resulting from Entrant's participation in or attempt to participate in the Sweepstakes, or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by Sponsor or the Released Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Promotion: (a) hardware or software errors; (b) faulty computer, cable, satellite, network, cellular, electronic, Internet connectivity or other online or network communication problems; (c) errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; (d) garbled, jumbled or faulty data transmissions; (e) failure of any online transmissions to be sent or received; (f) lost, late, delayed or intercepted transmissions; (g) inaccessibility of the Website; (h) traffic congestion on the Internet or the Website; (i) unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; (j) error, omission, interruption, deletion, defect, theft or destruction of, unauthorized access to, delay in operation, transmission, distribution of, alteration of, Entry/game play procedure, whether caused by the Entrant, or otherwise; (k) any of the equipment or programming associated with or utilized in this Promotion, or otherwise; or (l) destruction of any aspect of the Promotion, or loss, misdirection, inaccessibility or unavailability of an email account used in connection with the Promotion. The Released Parties are not responsible for any printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the announcement of the prizes or any Promotion-related materials. Without in any way limiting the foregoing, if due to technological, programming, electronic or other error of any kind, more than one hundred and ninety-two (192) instant win claims are received, Sponsor/Administrator will only award one hundred and ninety-two (192) in a random drawing from among all eligible Entrants claiming an instant win prize (excluding any instant win prizes already awarded.) IN NO EVENT WILL MORE THAN THE STATED NUMBER OF INSTANT WIN PRIZES LISTED IN SECTION 5 BE AWARDED. Use of Website is at user’s own risk. The Released Parties are not responsible for any personal injury, death or property damage or losses of any kind which may be sustained to Entrant’s, or any other person's mobile phone/computer resulting from participation in the Promotion. Sponsor is not responsible for any human error that may occur in the processing of the Sweepstakes.

DISCLAIMER OF WARRANTIES: IN NO EVENT WILL THE RELEASED PARTIES AND/OR THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE SWEEPSTAKES, YOUR ACCESS TO AND USE OF ANY PROMOTION RELATED WEBSITE AND/OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. IN NO EVENT SHALL THE RELEASED PARTIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED FIVE DOLLARS ($5.00). WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND FROM SPONSOR, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

8. CONDITIONS OF PARTICIPATION/GENERAL RULES: By entering, each Entrant agrees (a) that Sponsor and its designees shall have the right and permission to use in any manner (unless prohibited by law) Entrant's name, voice, likeness, photograph, nickname, city and state of residence and/or other indicia of Entrant’s identity, for advertising and/or trade and/or promotion and/or any other purpose now or hereafter known anywhere in the world in perpetuity without compensation, permission or notification to Entrant, or any third parties, except where prohibited by law; (b) to release the Released Parties from any and all liability and to indemnify, defend and hold harmless the Released Parties from and against any claim, action, liability, loss, injury or damage to Entrant or any other person or entity, including, without limitation, personal injury or death to Entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of (i) the acceptance, possession, use or misuse of any prize(s); (ii) participation in or administration of this Sweepstakes; (iii) the exploitation of any of the rights granted herein; and (iv) any element of this Sweepstakes; (c) to assume all liability for any injury or damage related to (a) (i)-(iv); (d) to be bound by the Official Rules and the Administrator's decisions which are final; (e) to waive all rights to claim or collect punitive, incidental, consequential or any other damages; (f) that all causes of action relating to this Sweepstakes will be resolved individually without resort to any form of class action; (g) that any and all claims, judgments, or awards shall be limited to actual out of pocket costs incurred (if any), excluding attorneys' fees; and (h) that New York law shall apply exclusively to the Sweepstakes and that any dispute with respect to the Sweepstakes shall be resolved in either the federal or state courts located in the County of New York, State of New York, regardless of conflict of law/choice of law provisions of New York or any other jurisdiction.

Released Parties are not responsible for (1) lost, interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections, miscommunications, computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other errors or malfunctions of any kind whether computer, software, hardware, network, technical, human, mechanical, electronic, seeding or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Sweepstakes, Sweepstakes entries, or prize claims, the announcement of the prizes or in any Sweepstakes-related materials, or for any damage to Entrant's or other person's hardware or software (or mobile device) as a result of participation; (2) failed, incomplete, undeliverable, garbled, delayed, late, lost, misdirected, stolen, or any combination thereof, entries, prize notifications or prize claims; (3) damage to Entrant's or any person's mobile device or the contents thereof; (4) any condition caused by events that may cause the Sweepstakes to be disrupted or corrupted; or (5) any inability of any winner to accept a prize. Persons found tampering with or abusing any aspect of this Sweepstakes or whose conduct potentially compromised the Sweepstakes, who attempt to defraud Sponsor/Administrator in conjunction with game play/entry or who are in violation of these Official Rules as solely determined by the Administrator will be disqualified and all associated Sweepstakes entries/game plays will be void with instant win prize won being forfeited. Every submission must be manually keystroked and manually entered by the Entrant and repetitive, automated electronic submission of Sweepstakes entries/game plays is specifically disallowed. Use of automated entry software or programs is prohibited and entry/game play through any such means is void.

Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes if fraud, technical failures or errors, viruses, bugs, unauthorized human intervention or any or other similar causes or any other factor beyond Sponsor's reasonable control impairs or compromises the administration, security, integrity or fairness of the Sweepstakes (or portions thereof), as determined by Sponsor in its sole discretion, and limit entries/game plays to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion. In the event the Sweepstakes is cancelled or terminated, notice will be posted online at www.tictacsummer.com and Sponsor reserves the right, at its sole discretion, to award the Grand Prizes and make the instant win prizes available to be won in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control. Entry information becomes property of Sponsor.

In the event a dispute arises regarding the specific individual entitled to receive a prize, an entry will be deemed made by the "authorized e-mail account holder" of the e-mail address submitted on the online entry form. "Authorized e-mail account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrant may be requested to provide Sponsor/Administrator with proof that the Entrant is the authorized e-mail account holder of the e-mail address in question. Any damage made to any Sweepstakes-related website by an Entrant will be the responsibility of the authorized e-mail account holder of the e-mail address submitted on the online entry form that is associated with the damage in question. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries/game plays which are suspected of being fraudulent (including those using robotic, automatic, programmed, or similar methods of participation) may be disqualified (and any instant win prize won will be forfeited), based on determinations made solely by Sponsor/Administrator. If an Entrant submits more than the stated number of entries/game plays permitted, and/or if Sponsor and/or Administrator suspects that an Entrant attempted to obtain additional entries/game plays by using multiple email addresses, user IDs, registrations, identities or any other method, all entries/game plays submitted by the Entrant will be declared null and void and, in such event, the culpable individual will forfeit any instant win prize won.
